I. Terms of Electronic Services Provided on the Website coldwellbanker.pl

For the purposes of these Terms and Conditions, the following terms shall have the meanings set forth below:

Prosta 70, 00-838 Warsaw, registered in the Register of Entrepreneurs of the National Court Register under KRS number 0000317400.

Website – the website owned by COLDWELL BANKER COMMERCIAL SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (formerly Nuvalu Polska Sp. z o.o. Sp.k.), accessible at www.coldwellbanker.pl.

User – any natural person using the Website.

Material – any content made available by COLDWELL BANKER COMMERCIAL SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (formerly Nuvalu Polska Sp. z o.o. Sp.k.) on the Website in such a way that any User can access it at a place and time of their choosing, including content in the form of text, graphics, photographs, audio, or audiovisual materials.

Newsletter – a service that involves delivering to the User information about buildings and rental spaces exclusively offered by COLDWELL BANKER COMMERCIAL SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (formerly Nuvalu Polska Sp. z o.o. Sp.k.), in the form of email messages sent to the email address provided by the User.

Terms and Conditions – these Terms and Conditions.


Device – any electronic device equipped with a web browser that allows the User to view and use the Website at a place and time of their choosing.

Services – services provided electronically by COLDWELL BANKER COMMERCIAL SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (formerly Nuvalu Polska Sp. z o.o. Sp.k.) via the Website, in particular services enabling access to Materials, submitting CVs, and the Newsletter.

The Terms and Conditions specify the rules, scope, and conditions for Users to use the Services provided by COLDWELL BANKER COMMERCIAL SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (formerly Nuvalu Polska Sp. z o.o. Sp.k.) via the Website.

2. The following Services are provided in particular via the Website:

1) Providing access to Materials;

2) A form enabling the submission of CVs;

3) Newsletter.

3. To properly use all Services through the Website:

1) For laptops or desktop computers, the following is required:

a) An internet connection with a bandwidth of at least 2 Mbit/s,

b) A browser supporting the HTML5 standard, in particular: Google Chrome 34, Mozilla Firefox 30, Safari 5, Internet Explorer 9, MS Edge,

c) An operating system of at least Windows 7, Ubuntu 13,

d) Enabling support for JavaScript technology and so-called “cookies”,

e) For certain Services, to take full advantage of their functionality, it may be necessary to enable support for the secure encrypted data transmission protocol (so-called “SSL”) in the browser.

On mobile devices – it is required to have a device with an operating system no older than iOS 7.0 or Android 4.03.

5. COLDWELL BANKER COMMERCIAL SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (formerly Nuvalu Polska Sp. z o.o. Sp.k.) provides the User with Services through the Website based on an agreement concluded between COLDWELL BANKER COMMERCIAL SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (formerly Nuvalu Polska Sp. z o.o. Sp.k.) and the User, under the terms specified in the Regulations. During the provision of the Services, the User is obliged to comply with the provisions of these Regulations.

6. COLDWELL BANKER COMMERCIAL SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (formerly Nuvalu Polska Sp. z o.o. Sp.k.) expresses its willingness to be bound by the Service provision agreement from the moment a given Service is made available through the Website. The User expresses their willingness to be bound by the Service provision agreement from the moment they request the activation of a given Service. The condition for concluding Service provision agreements is the acceptance of the Regulations, provided that COLDWELL BANKER COMMERCIAL SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (formerly Nuvalu Polska Sp. z o.o. Sp.k.) may make the use of a given Service conditional on the electronic acceptance of the Regulations.

7. The User is obliged to use the Website in a manner consistent with applicable law, social and customary norms, and the provisions of these Regulations. In particular, the User undertakes to:

1) not to post any content of an unlawful nature through the form;

2) not to use the Materials and other elements of the Website or the Website as a whole for purposes unrelated to the provision of Services to the User by COLDWELL BANKER COMMERCIAL SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (formerly Nuvalu Polska Sp. z o.o. Sp.k.);

3) not to disrupt the operation of the Website, computer systems, servers, or networks of COLDWELL BANKER COMMERCIAL SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (formerly Nuvalu Polska Sp. z o.o. Sp.k.), in particular, it is prohibited to:

(8) Use of the Website by the User in a manner contrary to the law, rules of social coexistence, good morals or these Regulations shall justify the immediate termination of the provision of Services to the User in question.

9. COLDWELL BANKER COMMERCIAL SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (formerly Nuvalu Polska Sp. z o.o. Sp.k.) shall be entitled to all rights to works forming part of the Website in whole and in fragments, to Materials and other elements of the Website, textual, graphic, multimedia.

10. COLDWELL BANKER COMMERCIAL SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (formerly Nuvalu Polska Sp. z o.o. Sp.k.) does not guarantee the uninterrupted availability of the Website or the Services.

(1) You may post your cv via the form available on the Website at www.coldwellbanker.pl for the purpose of informing you about recruitment processes and conducting recruitment processes.

(2) By posting a cv via the form available on the Website and filling it out, agreeing to the processing of personal data and accepting the Terms and Conditions, the User agrees to be informed about recruitment processes and to participate in recruitment processes.

(3) The principles on which the Users’ personal data are processed in connection with the submission of a cv via the form available on the Website are contained in the Information Clause available at www.coldwellbanker.pl.

(4) You may withdraw your cv at any time by sending a message via email to: praca@coldwellbanker.pl or by withdrawing your consent to the processing of your personal data.

(2) Complaints should be reported to COLDWELL BANKER COMMERCIAL SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (formerly Nuvalu Polska Sp. z o.o. Sp.k.) via e-mail to: marketing@coldwellbanker.pl.

(3) The notification of the complaint referred to in paragraph (2) shall include at least:

a) e-mail address or address to which correspondence should be addressed to the User,
b) description of the subject of the complaint, date and time of the problem.

4. COLDWELL BANKER COMMERCIAL SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (dawniej Nuvalu Polska Sp. z o.o. Sp.k.) udzieli odpowiedzi na reklamację zgłoszoną zgodnie z ust. 2 nie później niż w ciągu 14 dni liczonych od momentu jej otrzymania, zaś w przypadkach szczególnie skomplikowanych nie później niż w ciągu 30 dni.

5. COLDWELL BANKER COMMERCIAL SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (dawniej Nuvalu Polska Sp. z o.o. Sp.k.) przekaże Użytkownikowi odpowiedź na reklamację zgodnie z ust. 4 na piśmie na papierze lub w ramach wiadomości e-mail na adres wskazany przez niego zgodnie z ust. 3 lit. a.

The protection of Users’ personal data, the rules for collecting data using cookies and other issues relevant to privacy on the Portal are governed by the Privacy Policy, available on the Portal’s website at https://coldwellbanker.pl/polityka-prywatnosci/ and the Information Clauses located next to individual forms.

(1) In matters not covered by these Regulations, the applicable provisions of law shall apply, in particular the provisions on the provision of electronic services, the Act on Copyright and Related Rights and the Civil Code Act.

2 The Regulations shall come into force on October 14, 2019.

3. Regulamin może być zmieniany przez Administratora na zasadach określonych poniżej. W przypadku zmiany niniejszego Regulaminu jego nowa wersja zostanie opublikowana na Stronie Internetowej wraz ze wskazaniem daty jego wejścia w życie. Stosunki pomiędzy COLDWELL BANKER COMMERCIAL SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (dawniej Nuvalu Polska Sp. z o.o. Sp.k.) a Użytkownikiem reguluje Regulamin obowiązujący w dniu zawarcia umowy o świadczenie danej Usługi do czasu zaakceptowania przez Użytkownika nowego Regulaminu. Skutki niezaakceptowania nowego Regulaminu każdorazowo określa COLDWELL BANKER COMMERCIAL SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (dawniej Nuvalu Polska Sp. z o.o. Sp.k.) z uwzględnieniem charakteru wprowadzonych w Regulaminie zmian, o czym informuje Użytkownika wraz z publikacją nowego Regulaminu.

(4) These Regulations are made available free of charge through the Website in a form that allows the acquisition, reproduction and recording of the content of the Regulations by means of a data communications system.
